Terms of Service — SyncApp

These Terms of Service ("Terms") govern your use of every SyncApp product — currently SyncApp for OneDrive, with seven more flavors planned across 2026 and 2027 (collectively, the "Apps"). By installing, signing into, or using any SyncApp App, you agree to these Terms.
This is a draft. Have your lawyer review before publishing.
1. The short version
You can use SyncApp products to sync your own files between your device and a cloud account you control. We don't own your files, we don't read them, and we don't host them. If you stop paying, the free tier still works for the basics; if you cancel a subscription, your access to Pro features ends at the end of the current billing period.
2. Who's offering this service
The SyncApp Apps are built and operated by Gamalabs, an independent app studio based in Hyderabad, Telangana, India. References to "we", "us", "the SyncApp studio", or "SyncApp" in these Terms refer to Gamalabs. Contact: support@syncapp.app.
We are not Microsoft, Google, Apple, Dropbox, or any other cloud provider. SyncApp is independent. The cloud destinations integrated by our Apps are accessed via each provider's published APIs, not under any commercial partnership.
3. Your account & cloud authorization
To use a SyncApp App with a particular cloud destination, you authorize the App to access your cloud account on your behalf. This authorization is granted by you to the App via the cloud provider's standard sign-in flow (e.g. Microsoft's MSAL, Google OAuth, etc.). You can revoke this authorization at any time, either from within the App or from your cloud provider's account settings.
You are responsible for the security of your cloud credentials. SyncApp never sees your cloud password.
4. Acceptable use
You may use the Apps to sync files you own or have explicit permission to sync. You agree not to:
- Use the Apps to sync content that infringes someone else's intellectual property, that is illegal in your jurisdiction or the cloud provider's jurisdiction, or that violates the cloud provider's own terms of service
- Attempt to reverse engineer, decompile, or modify the Apps beyond what's permitted by applicable law (e.g. interoperability research is generally permitted in the EU)
- Bypass licence checks, free-tier limits, or anti-piracy verification
- Resell access to the Apps or sublicense Pro features to third parties
- Use the Apps to operate a commercial sync service for third parties (each user must hold their own licence)
We reserve the right to suspend or revoke access for users who violate these conditions.
5. Pricing, subscriptions, and the lifetime tier
Each SyncApp App has a free tier and a Pro tier. Pro is offered in three forms:
- Monthly subscription — billed monthly via Google Play Billing. Auto-renews unless cancelled.
- Yearly subscription — billed yearly via Google Play Billing. Auto-renews unless cancelled.
- Lifetime purchase — a one-time payment that grants permanent Pro sync access for that App on your account.
"Lifetime" means as long as the App continues to be operated and distributed. If we permanently discontinue an App, lifetime purchasers are not entitled to a refund, but we will give 90 days' written notice and provide a way to export sync configuration before shutdown.
Prices vary by country, may include local taxes, and may change with notice. Existing subscribers remain on their current price for the duration of their current billing period.
What lifetime includes — and what it doesn't
The lifetime tier covers the Pro sync feature set as it stands at the time of purchase plus all future improvements to that feature set: unlimited sync pairs, instant upload, two-way sync, every schedule interval, parallel transfers, battery and network conditions, retry configuration, the full file-rule and filter system, and any future capability that improves the core "move files between this device and your cloud" promise. Existing lifetime owners are never moved off these features.
A second category of features is delivered on the Pro subscription tier and is not included in lifetime. These are features whose ongoing operating cost is recurring (server-side computation, third-party API fees, or staff time) and which we therefore charge for on a recurring basis. The first such feature is drive analytics — the in-app dashboard that scans your cloud, categorises every file, and renders byte-level breakdowns. More subscription-tier features will be added over time; the in-App "Settings → Plans" surface is the source of truth for the current list.
A user can hold a lifetime purchase and an active monthly or yearly subscription simultaneously. The subscription unlocks the subscription-tier feature set; the lifetime unlocks the sync feature set. Cancelling the subscription does not affect lifetime sync access; conversely, the existence of an active subscription does not extend or alter lifetime ownership in any way.
This split sets a clear, durable contract: you can buy lifetime once and never pay again for sync, while a separately-priced subscription opens up additional features that we couldn't responsibly bundle into a one-time purchase.
Free trial
If a free trial is offered (in-Play-Store or in-App), you'll be informed of the trial duration before purchase. After the trial ends, the subscription auto-renews unless cancelled in your Google Play account.
6. Refund policy
Google Play handles billing and most refund requests directly. For:
- Subscriptions — refunds are governed by Google Play's policy. Within 48 hours of purchase, you can request a refund through Google Play. Beyond that, contact us at support@syncapp.app and we'll evaluate on a case-by-case basis.
- Lifetime purchases — Google Play's automatic 48-hour refund window applies. After 48 hours, lifetime purchases are non-refundable, except as required by applicable consumer protection law.
- Subscription cancellation — cancel anytime via your Google Play subscriptions page. You retain access to Pro features through the end of the current billing period.
We do not offer pro-rated refunds for unused subscription time.
7. Free tier and feature gating
The free tier exists permanently and supports a generous subset of features (a limited number of folder pairs, basic sync rules, etc.). Specific limits are documented in-App and may be adjusted with reasonable notice.
We reserve the right to introduce new Pro-tier features, but we will not remove features that are currently in the free tier as a way to compel upgrades. The list of free-tier features at the time you started using the App is a floor, not a ceiling.
8. Updates and changes to the Apps
We push App updates regularly to fix bugs, add features, and improve performance. By using the Apps, you accept that updates may change UI, feature placement, or workflow.
We reserve the right to discontinue or substantially modify any App with 90 days' written notice (delivered via in-App notification, the SyncApp website, or email to your support contact if you've ever filed a ticket).
9. Intellectual property
The Apps, their source code (where closed-source), branding, the SyncApp name and logo, and the visual design are the intellectual property of the SyncApp studio. You receive a non-exclusive, non-transferable licence to use the Apps under these Terms; you do not receive any ownership rights.
The names "OneDrive", "Google Drive", "Dropbox", "iCloud", "Box", "MEGA", "pCloud", and any other cloud-provider trademarks remain the property of their respective owners. SyncApp uses these names solely to identify which cloud destination each of its Apps integrates with, in accordance with nominative-fair-use doctrine.
10. Privacy
Your privacy is governed by the Privacy Policy. The short version: your file contents go directly between your device and the cloud you choose; SyncApp's servers never handle them.
11. Disclaimers
The Apps are provided "as is" and "as available". We disclaim all warranties to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that:
- The Apps will be uninterrupted, error-free, or virus-free
- Any specific file will sync within any specific time
- The Apps will be compatible with every Android device or OS version
- The cloud destinations will remain available or behave consistently
If a sync fails or a file is corrupted in transit, you remain responsible for keeping your own backups separate from the SyncApp tooling.
12. Limitation of liability
To the maximum extent permitted by law, SyncApp is not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, revenue, or goodwill, arising out of or in connection with your use of the Apps.
In any case, our total aggregate liability to you for any claim arising under these Terms is limited to the greater of (a) the amount you paid SyncApp in the 12 months preceding the claim, or (b) USD $50.
13. Indemnification
You agree to indemnify and hold SyncApp harmless from any claim arising out of your use of the Apps in violation of these Terms or any applicable law.
14. Termination
You may stop using any SyncApp App at any time by uninstalling it. If you have a subscription, cancel via Google Play to stop auto-renewal.
We may suspend or terminate your access if you violate these Terms or if your continued use poses a security or legal risk to us, with notice where possible.
Upon termination, sections 9 (IP), 11 (disclaimers), 12 (liability), and 16 (governing law) survive.
15. Changes to these Terms
We may update these Terms occasionally. Material changes will be announced in-App and at syncapp.app/terms with at least 30 days' notice. Continued use after the notice period constitutes acceptance.
16. Governing law and dispute resolution
These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Disputes arising out of or relating to these Terms or the Apps will be resolved in the courts of Hyderabad, Telangana, India, which shall have exclusive jurisdiction.
If you are a consumer in the EEA, UK, or any other jurisdiction whose mandatory consumer-protection law would otherwise apply, nothing in these Terms overrides those mandatory rights.
